Visit Connect & Visit Discover Terms of Use

The following terms of use (“Terms”) apply to your use of the product Visit Connect & Visit Discover (the “Product”) via a mobile phone application (the “App”) owned by GES Event Intelligence Ltd. (“GES”).   

Use of Product.  GES grants you a personal non-transferrable licence to use the Product.  You will have a unique user log in which may not be transferred or otherwise shared.  You acknowledge and agree that GES will not be responsible for any loss of information stored on the App or within the Product.   

Limitation of Liability.  GES shall have no liability to you for any errors arising from use of the Product or the App.  Use of the App as a scanner may cause loss of data where you fail to synchronise the data in full or where the cache memory of the App is cleared when not synchronised or when the device upon which the App is lost or stolen.  GES will under no circumstances be liable for any damages, including loss of profit, loss of use, loss of revenue, loss of anticipated savings, loss of business or loss of data (in each case whether direct, indirect or consequential).   

Further, GES does not accept liability for any loss of data arising from use of Product or the App. GES accepts no liability for loss of or degradation to data on the Product platform.  You acknowledge that you will back up data.   

Intellectual Property Rights. GES owns all Intellectual Property Rights in the Product and no such rights are transferred to you hereunder.  Intellectual Property Rights means any and all patents, design rights, trademarks, business names, domain rights names, copyrights, database rights and all other intellectual property rights of a similar or corresponding nature. 

General.  If any part of these Conditions is found by a Court to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these Terms which will continue to be valid and enforceable as permitted by law. 

No failure by either party to exercise any right or remedy or any delay in such exercise shall operate as a waiver, nor shall any single or partial exercise of any right or remedy preclude any further exercise of it or the exercise of any other right or remedy. 

In the event of any dispute, these Terms shall be governed by and construed in accordance with the laws of England.
